This document regulates the terms and conditions governing access, navigation, use of the Website and contracting of the BestViews SaaS service (hereinafter, the "Terms").

Access or use of the Platform implies that you acquire the status of User and represents full and unreserved acceptance of these Terms.

2. Purpose of the Terms

BestViews is an online platform (SaaS model) that allows real estate agents, agencies and other professionals in the sector to improve and transform property photographs using artificial intelligence-based tools (hereinafter, the "Service").

These Terms regulate:

Access and use of the Website.

Creation and management of user accounts.

Contracting of the different subscription plans and credits.

Rights and obligations of the parties.

3. Acceptance and scope of application

By registering, checking the acceptance box and/or contracting a paid plan, you declare that:

You have read and understand these Terms.

You have sufficient legal capacity to contract.

You act on your own behalf or on behalf of a company or professional client.

If you do not agree with these Terms, you should not use the Platform.

In case of conflict between these Terms and any other translated version, the Spanish version shall prevail, without prejudice to your inalienable rights.

4. User registration and account

To use BestViews it is necessary to create a user account, providing truthful and updated data (name, email, password and, where applicable, company data).

You agree to:

Not share your credentials with third parties.

Maintain the confidentiality of your password.

Notify Altoclick S.L. of any unauthorized use of your account.

Altoclick S.L. may suspend or cancel accounts that:

Breach these Terms.

Make abusive or fraudulent use of the Service.

Compromise the security or operation of the Platform.

5. Description of the BestViews service

BestViews offers, among others, tools such as:

Automatic improvement of real estate photos (Smart Enhance).

Image re-composition (perspective, framing, etc.).

Virtual home staging (furnishing or emptying rooms).

Other advanced functionalities for interiors and floor plans, depending on the contracted plan.

BestViews:

Is not an in-person photography service, but a digital support tool.

Does not guarantee a specific number of sales or rentals, or specific commercial results.

May update, add or remove functionalities at any time to improve the Service, reasonably informing users.

6. Subscription plans, credits and packs

6.1. Subscriptions

Access to BestViews functionalities is done through subscription plans (monthly or annual, as offered at any given time) that include a certain number of credits.

The details of each plan (price, credits included, available tools) are shown on the Pricing page of the Website.

Unless otherwise indicated, subscriptions are automatically renewed at the end of each period, charging the amount to the same payment method.

You can cancel automatic renewal at any time from your account, effective at the end of the contracted period.

6.2. Credits

BestViews works through a credit system, which are consumed when using the different tools (for example, for each processed image, depending on the type of model or functionality).

Credits included in the plan are renewed monthly with each subscription period.

Unless expressly stated otherwise, they are not cumulative from one month to another.

Some plans may allow the purchase of additional credit packs, which may have different expiration conditions (for example, not expiring while the account is active).

6.3. Prices and taxes

Plan and pack prices are always shown in the currency and with applicable taxes according to the user's location and current regulations.

Altoclick S.L. may modify prices in the future, informing with reasonable advance notice.

7. Payments, billing and right of withdrawal

Payments are made through secure third-party payment gateways (for example, Stripe or others), without Altoclick S.L. storing the complete data of your card or payment method.

In the case of users acting as businesses or professionals (B2B), the right of withdrawal for consumers does not apply.

If you access and use the Service as a consumer, when contracting a subscription plan:

You acknowledge that the Service starts immediately.

You expressly consent to the provision during the withdrawal period.

You accept that, once the provision has begun, you lose the right of withdrawal in accordance with art. 103.m) of the Consolidated Text of the General Law for the Defense of Consumers and Users.

In any case, if you believe that an improper charge or error has occurred, you can contact us at info@bestviews.ai to analyze your case.

8. Permitted use of the Service

You agree to use BestViews diligently and in accordance with the law, and in particular to:

Not upload images or content that violate third-party rights (intellectual property, image, privacy, etc.).

Not use the Platform to disseminate illegal, defamatory, violent, sexist, racist content or content contrary to public order.

Not upload images of identifiable persons without the corresponding authorizations or legal bases.

Not use BestViews to generate misleading content, identity theft or deepfakes that may cause harm to third parties.

Not attempt unauthorized access to other accounts, systems or networks connected to the Platform.

Altoclick S.L. reserves the right to suspend or cancel access to the Service in case of such breaches.

9. Intellectual and industrial property

9.1. About the Platform

The BestViews Platform, its code, design, logos, trademarks, texts, images and other elements are owned by Altoclick S.L. or third parties who have authorized their use, and are protected by intellectual and industrial property regulations.

Altoclick S.L. grants the User a non-exclusive, limited, revocable and non-transferable license to use the Platform during the validity of their subscription, in accordance with these Terms.

It is prohibited to:

Copy, modify, decompile or reverse engineer the Platform.

Create derivative services based on BestViews without express authorization.

Use trademarks or distinctive signs of Altoclick S.L. without permission.

9.2. About user images and content

The images and content you upload to BestViews remain your property or your clients' property, as applicable.

By uploading them, you grant Altoclick S.L. a non-exclusive and limited license to:

Host and process said content.

Generate transformed or improved versions.

Store temporary and backup copies while the Service is provided.

Altoclick S.L. does not claim ownership of your images, nor does it commercialize them with third parties. We may use aggregated and anonymous data derived from the use of the Platform for analysis, service improvement and statistics purposes.

10. Limitation of liability

Within the maximum limits permitted by law:

Altoclick S.L. does not guarantee that the results generated by BestViews will always be perfect, nor their suitability for a specific purpose.

We are not responsible for commercial decisions you make based on the Platform's results.

We do not guarantee continuous availability of the Service, although we will make reasonable efforts to avoid interruptions.

In no case shall Altoclick S.L. be liable for:

Loss of profits, income or data.

Indirect, consequential or lost profit damages.

Unless the law provides otherwise, the total liability of Altoclick S.L. to the User for any claim related to the Service shall be limited to the total amount actually paid by the User in the 12 months prior to the event giving rise to the claim.

11. Suspension and termination of service

Altoclick S.L. may temporarily suspend the Service for technical, security or maintenance reasons, always trying to minimize the impact.

It may also terminate the contract and cancel a User's account in case of:

Serious breach of these Terms.

Fraudulent or abusive use of the Service.

Repeated non-payment.

The User may stop using the Service at any time and cancel the renewal of their subscription from their account. Cancellation does not imply refund of amounts already paid for initiated periods.

12. Modification of the Terms

Altoclick S.L. may modify these Terms to adapt them to legal, technical or business changes. The current version will always be available on the Website.

In case of substantial modifications, the User will be informed by notice on the Platform or by email. If you continue using the Service once the new Terms have come into force, it will be understood that you accept them.

13. Applicable law and jurisdiction

These Terms are governed by Spanish law. For any dispute that may arise from their interpretation or application, the parties submit to the Courts of Barcelona, unless applicable regulations provide for another mandatory jurisdiction.
